Man of the Month Calendar" Contest Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES
NOT IMPROVE YOUR CHANCES OF WINNING. The “Zest®
Adventure Man of the Month Calendar” Contest (the "Contest”),
brought to you by Procter & Gamble (the "Sponsor”),
is governed by these “Official Rules”. The Contest
is open to legal U.S. residents of the 50 United States and District
of Columbia and 18 years of age or older. Void where prohibited.
Sponsor reserves the right, at any time, to verify eligibility
requirements, in any manner it deems appropriate. Employees and
directors of Sponsor, its parent, subsidiary, and affiliated companies,
licensees, advertising, promotion or production agencies and provider
companies (and their immediate family members and individuals residing
in their same household) are not eligible. All federal, state and/or
local rules and regulations apply.
2. THE CONTEST: The Contest consists of two (2)
rounds. In Round 1, entrants submit photos of themselves participating
in adventurous activities and a brief essay (200 words or less)
describing how/why they embody the spirit of adventure. Photos and
essays will each be given a score from one to 10 based on the judging
criteria outlined below, one being the lowest score and 10 being
the highest score. The total score will be the sum of both the photo
score and the essay score. Photos and essays will be judged and
twenty-four (24) Semi-Finalists will advance to Round 2.
In Round 2, points from Round 1 will
be carried over to Round 2 and weighted 80% of the final score;
the other 20% of the final score will be determined by online
voting. Each Semi-Finalist’s
photo and essay will be posted on the “Zest for Adventure”
web site. The candidates will be judged and the 12 entrants receiving
the highest number of votes will be deemed the Winners as defined
herein. All definitions, details and entry guidelines are described
below.
3. HOW TO ENTER:
ROUND 1: Submit one (1) color photo electronically
to zestcalendar@gcigroup.com or by mail of candidate participating
in adventurous activity, along with completed Entry and Release
Forms (available online at www.zestforadventure.com or
via email request from: zestcalendar@gcigroup.com) to: The Procter
& Gamble “Zest Men of Adventure Calendar” Contest,
c/o: GCI Group, Attn: Jennifer Goldin, 825 Third Ave. Floor 22,
New York, NY 10022. Photos submitted by mail should be either 3x5
or 4x6 inches in size. Submissions must be received between July
18 at 12:01 am EST and September 5, 2006 at 11:59 pm EST. Limit
one (1) entry per person. All entries must be the fully original
creations of the entrants.
ROUND 2: (applicable to Semi-Finalists only):
The twenty-four (24) Semi-Finalists identified through a first round
of judging (as described in Rule #5) will have their photos and
essays posted on www.zestforadventure.com
and compete with other semi-finalists to secure votes from website
visitors.
Contestant photos and essays are sometimes hereafter referred to
as “Entry” or “Entries”. Entries may appear
in Sponsor’s advertisement(s) and/or on Sponsor’s Website,
but Sponsor is not obligated to make any such use, and any use
of photo and/or description is at the sole and exclusive option
of Sponsor. Only fully completed Entries are eligible. All Entries
become the sole property of Sponsor and will not be acknowledged
or returned. In the event an insufficient number of entries are
received, Sponsor reserves the right to cancel the Contest and
shall be under no obligation to award the prizes.
The public voting will take place between September 15 to October
2, 2006 (“Voting Period”) by accessing www.zestforadventure.com
and following the voting instructions. Voters must be legal residents
of the U.S. and 18 years or older. Individuals may vote only once.
Sponsor reserves the right to reject any vote that they consider
to be fraudulently generated or duplicated, in their sole discretion.
4. ENTRY CONDITIONS: By submitting an Entry,
you warrant that (i) it is your own original creation and that
it does not violate any law, regulation or right of any third
party, including but not limited to copyright, trademark, rights
of publicity or privacy, (ii) that you have followed the Official
Rules of the Contest, and (iii) the Entry has not been entered
into any other contest or won any other award.. If Entry contains
an identifiable person(s) other than entrant, by submitting an
Entry, entrant represents and warrants that he/she has obtained
the consent of such person(s) to use the photo as outlined herein
Further, by submitting an Entry, entrant grants permission for
Sponsor to distribute, post, display and otherwise make use of
the Entry (even if modified) in Sponsor’s
advertisement(s) and/or on the World Wide Web as is consistent
with these Official Rules (as solely determined by Sponsor),
and in any and all media know known or hereinafter developed
without territorial or time limitations and warrants and represents
that he/she has all right to grant such permission. Any Entry
that, in the sole opinion of Sponsor, is considered inappropriate
or not suitable for publication (all as solely determined by
Sponsor) will be deemed ineligible. Proof of submission will
not be deemed to be proof of receipt by Sponsor. Correspondence
and inquiries concerning Contest will not be accepted or acknowledged.
5. JUDGING – ROUND 1: All
eligible entries will be judged by P&G representatives whose decisions are final
and binding in all judging matters relating to this Contest. Entries
will be judged equally on the following criteria: (i) 1/3 Articulation
of entrant’s adventurous mindset, (ii) 1/3 physical appearance
and (iii) 1/3 creativity. Twenty-four (24) Semi-Finalists will
be determined by the highest score of cumulative points for all
criteria awarded by judges. In case of a tie, the tied entries
with the highest cumulative point scores in articulation of an
adventurous mindset will be declared a Semi-Finalist. If tie continues,
the tied entries with the highest cumulative point scores in physical
appearance and creativity will be declared a Semi-Finalist. If
Semi-Finalist(s) cannot be determined in accordance with the above
procedure, only tied entries will be evaluated by a new judge according
to the original two (2) criteria. The tied entry with the highest
cumulative scores determined by a new judge will be declared a
Semi-Finalist. Semi-Finalists will be determined on or about September
15 and will be notified on or about September 29 by email.
6. JUDGING – ROUND 2: Semi-Finalists’
entries will be voted on by visitors to zestforadventure.com based
equally on the following criteria:(i) 1/3 articulation of adventurous
mindset, (ii) 1/3 physical appearance, and (iii) 1/3 creativity.
The Round 2 score will represent (20%) of the total score.
The Round 1 score will represent (80%) of the total score.
The total score will be calculated based on the sum of the
Round 1 score and the Round 2 score.
Twelve (12) male finalists with the highest
total scores received from September 15 to October 2, 2006 will
be featured in the Zest Man of the Month Calendar. One Grand
Prize Winner will be selected from the (12) male finalists based
on having the highest total score. The Grand Prize Winner will
be awarded the Grand Prize of an Adventure Trip for four people.
The Adventure Trip will be selected by P&G
and the winner will have one (1) year to redeem the prize.
In case of a tie for 12th place, the
tied entries with the highest cumulative point scores from round
one will be deemed the Finalist. If tie continues, the tied entries
with the highest cumulative point scores in articulation of entrant’s
adventurous mindset will be declared a Finalist.
7. FINALISTS’ CONDITIONS: Finalists will
be determined on or about November 15, 2006 and will be contacted
on or about November 30 by phone and email. If Finalist cannot be
contacted or if prize notification is returned as undeliverable,
an alternate Finalist will be selected who will be the entrant with
the next highest score.
8. PRIZE: Twelve (12) Finalists will be included
in the Zest Adventure Man of the Month Calendar. No substitution,
assignment, or transfer permitted, except by Sponsor who reserves
the right to substitute prize of equal or greater value, in Sponsor’s
sole discretion. One Grand Prize Winner will be awarded an Adventure
Trip for four people. The Adventure Trip will be selected by P&G
and the winner will have one (1) year to redeem.
9. CONDITIONS OF PARTICIPATION: Participants agree (a)
to these Official Rules and the decisions of Sponsor which are
final and binding, (b) that Sponsor, its parent, subsidiary and
affiliated companies, advertising and promotion agencies, and
all of their respective officers, directors, employees, representatives
and agents will have no liability whatsoever for, are released
and shall be held harmless by participants against any liability
for any injuries, losses or damages of any kind to persons, including
death, or property resulting in whole or in part, directly or
indirectly, from acceptance, possession, misuse or use of any
prize or participation in this Contest or Contest-related activities
and (c) except where legally prohibited, winners grant (and agree
to confirm that grant in writing) permission to Sponsor and those
acting under Sponsor’s authority
the right to the use of his/her name, Photo, Essay, image and biographical
information and statements, voice and/or likeness and prize information,
and/or entry video recording (and license the use of the entry,
which may be altered, changed, modified, edited, used alone or
with other works, as solely determined by sponsor) for advertising,
trade and promotional purposes without further compensation,
at any times or time, in all media now known or hereafter discovered
world wide and on the Internet and/or World Wide Web without
notice or review or approval.
10. REQUIRED DOCUMENTATION: Finalists’ and
Grand Prize Winner’s Entries will be deemed a Work Made For
Hire under the Copyright laws of the United States, but if it cannot
be so deemed, then winner may also be required to complete, sign
and return an irrevocable assignment, in the United States and World
Wide, of any and all right, title and interest that he/she may have
in the Entry, including but not limited to the copyright and “Droit
Moral” or “Moral Rights” (if any), therein, for
valuable consideration, the receipt and sufficiency of which is
hereby acknowledged. If sponsor requests the winner to do so, it
will be the winner’s responsibility to secure the Releases
and assignment. Should sponsor fail to request an assignment, as
stated, that shall not be deemed a waiver of Sponsor’s rights
and sponsor may at a later time request that assignment. Any such
assignment may be, as solely deemed by Sponsor, reasonably necessary
to establish the ownership of record of the copyrights and Moral
Rights transferred, or which may be transferred, under this Agreement.
Winners will be required to complete, sign, and return an Affidavit
of Eligibility, a Liability Release and, where lawful, a Publicity
Release prior to accepting the prize, within 14 days of prize notification.
If documents are not returned in a timely basis, or if any prize
notification or prize is returned as non-deliverable, or if winner
is found to be ineligible or not in compliance with these Official
Rules, such prize will be forfeited and an alternate winner selected.
Failure to comply with any of these requirements may cause prize
to be forfeited and awarded to alternate winner. All taxes and
unspecified expenses are solely the responsibility of the winner.
11. GENERAL PROVISIONS: Neither
Sponsor nor its agencies are responsible for lost, late, damaged,
delayed, destroyed, misdirected, incomplete, illegible, mutilated,
or postage-due mail or entries, or for interrupted or unavailable
network, server, or other connections, availability or accessibility
or miscommunications or failed computer, satellite, telephone
or cable transmissions, lines, or technical failure or jumbled,
scrambled, delayed or misdirected transmissions or video or computer
hardware or software malfunctions, failures or difficulties,
or other errors of any kind whether human, mechanical, electronic
or network; or the incorrect or inaccurate capture of entry or
other information or the failure to capture any such information.
Persons who tamper with or abuse any aspect of the Contest, as
solely determined by Sponsor, will be disqualified. Should any
portion of the Contest be compromised by virus, worms, bugs,
non-authorized human intervention or other causes which, in the
sole opinion of the Sponsor, corrupt or impair the administration,
security, fairness or proper play, or submission of entries,
Sponsor reserves the right in its sole discretion to suspend,
modify or terminate the Contest and judge winners from entries
received prior to the occurrence of such intervening cause or
as otherwise deemed fair and appropriate by Sponsor. Sponsor
is not responsible for any incorrect or inaccurate information,
whether caused by any form of tampering, hacking, or by any equipment
or programming associated with or utilized in the Contest, and
assumes no responsibility for any error, interruption, deletion,
defect, delay in operation, or transmission, communications line
failure, theft or destruction, or unauthorized use of phone or
phone lines. In case of dispute as to the identity of entrant,
Entry will be declared made by the authorized account holder
of the email address submitted at time of entry. “Authorized Account Holder” is
defined as the natural person who is assigned an email address
by an Internet access provider, online service provider, or other
organization (e.g., business, educational, institution, etc.)
responsible for assigning email addresses or the domain associated
with the submitted email address.
12. GOVERNING LAW AND ARBITRATION: This Contest
will be governed by and interpreted under the laws of the State
of Ohio, without application of any conflicts of law rules. Disputes
between the parties or their affiliates related to this Contest
shall be submitted to final, binding arbitration heard by a single
arbitrator in accordance with the then-current Commercial Arbitration
Rules of the American Arbitration Association (except as modified
herein). Any counterclaim not brought within thirty (30) days after
receipt of the arbitration notice shall be barred. The arbitration
shall be conducted in Hamilton County, Ohio in English. Unless otherwise
specified herein, the arbitrator may award any relief that he deems
proper, including but not limited to equitable relief. The award
shall be final and binding and enforceable in any court of competent
jurisdiction.
13. WINNER’S LIST: For
a list of Finalists and Grand Prize Winner, please send a stamped,
self-addressed envelope to: The “Zest Men of Adventure Calendar” Contest,
c/o GCI Group, Attn: Jetaun Adkins Boyle, 825 Third Ave. Floor
22, New York, NY 10022, for receipt by December 31, 2006. Residents
of Vermont may omit return postage.
14. SPONSOR: Procter & Gamble Distributing
Co., P&G Plaza, Cincinnati, OH 45202. Do not send correspondence
to this address.
Abbreviated Rules;
Limit 1 entry/person. Prize: Adventure Trip for
